Construction is officially underway atnbsp;Margaritaville Resort Orange Beach, marking a major milestone for the Alabama Gulf Coastrsquo;s hospitality and tourism industry. The groundbreaking ceremony took place Wednesday, May 14th, on the 83-acre waterfront site along the Intracoastal Waterway direct across from The Wharf.nbsp;The resort will bring over 400 coastal residences to the area, including luxury condominiums, condo-hotel units, and a mix of resort cottages, bungalows, and waterfront villas. A 1031 exchange is a provision in the United States tax code that allows an individual or entity to defer paying capital gains taxes on the sale of certain types of investment or business property. Under the 1031 exchange, the proceeds from the sale of the original property are reinvested in a similar type of property, which is referred to as a like-kind property. This reinvestment must take place within a certain time frame and follow specific rules and regulations. By deferring the capital gains taxes, the individual or entity can use the full proceeds from the sale to invest in the new property, allowing them to potentially build wealth faster than they would if they had paid taxes on the sale of the original property. Its important to note that the rules and regulations surrounding a 1031 exchange can be complex, and its recommended that individuals consult with a tax professional or financial advisor before pursuing this strategy.





Steps for completing a 1031 exchange:


1. Sell the original property: The first step is to sell the original property that you wish to exchange.


2. Identify replacement property: Within 45 days of selling the original property, you must identify one or more replacement properties that you plan to purchase as part of the exchange. The replacement properties must meet the requirements for like-kind property.


3. Enter into a purchase agreement: You must enter into a purchase agreement for one or more of the replacement properties within 180 days of selling the original property.


4. Use a qualified intermediary: To avoid disqualifying the exchange, you cannot take possession of the funds from the sale of the original property. Instead, you must use a qualified intermediary to hold the funds and facilitate the exchange.


5. Close on the replacement property: You must close on the purchase of the replacement property or properties within the 180-day window.


6. Report the exchange: Finally, you must report the exchange on your tax return and file IRS Form 8824. The amount of tax you owe will depend on the difference between the adjusted basis of the original property and the purchase price of the replacement property.

COASTAL Orange Beach is now open


A lot of activity is happening in Orange Beach at the intersection of AL-182 and Hwy 161. The city of Orange Beach has partnered with O.B. Land LLC in a public ndash; private partnership to provide public beach access and a family-friendly destination restaurant. The outdoor bar, kitchen and retail space is slated to open later this summer with plans for the indoor restaurant to open in January.

Tickets are now on sale for Tropic Falls Theme Parknbsp;at OWA. OWA entertainment district expanded its amusement park this summer to include a 100,000 square foot indoor-outdoor water park. Season Passes, which include the water park and amusement park, begin at $269.99 with a one-day admission ticket to both parks priced at $63.00 if purchased online. Tropic Falls is set to open phase one on June 27. OWA, pronounced ldquo;oh-wahrdquo;, is the Muscogee Creek Indian word for big water and Tropic Falls promises to provide just that. NEW UPDATE - MAY 12, 2020


Governor Ivey has announced an amended Safer-At-Home order during Fridays COVID19 press conference. The statewide health ordernbsp;will allownbsp;restaurants to reopen dining areas with limited table seating and follow all social distancing and sanitation guidelines. Close-contact service providers such as commercial gyms, fitness centers, barbershops, hair/nail salons are permitted to reopen subject to social distancing and sanitation rules. Other notable changes include removing the social gathering limit of 10 or less. You are stillnbsp;required to maintain 6 feet of distance between persons not from same household. The amended order will go into effect on Monday, May 11, 2020 and expire Friday, May 22, 2020 at 5:00PM.nbsp;

Alabama Governor Kay Ivey has announced a new Safer at Home order effective Thursday, April 30th at 5:00PM. The updated ordinance will allow the reopening of Alabama beaches under social distancing guidelines and reopening of retail businesses with a 50 occupancy rate. Social distancing measures include limiting public gatherings to 10 or less people and maintaining separation of 6 feet or more between members of different households.nbsp;


Inside seating for restaurants, breweries, and barsnbsp;is still prohibitednbsp;and limited to only take-out and curbside deliveries. Entertainment venues, close-contact service providers (barbers, hairdressers, nail salons, and tattoo shops), and athletic facilities (gyms and fitness centers) remain closed.nbsp;


Vacationnbsp;rental companies are taking reservations April 30th and onward fornbsp;Gulf Shores condosnbsp;andnbsp;Orange Beach condos. Condominium pools are now opennbsp;under social distancing guidelines. Condo associations may implement their own social distancing regulations on usage of community pools, gyms, and other amenities.nbsp;
